An Employer Identification Number, or EIN, is a nine-digit number the IRS assigns to a business. It works like a Social Security number for your company — a unique identifier the federal government, banks, and other institutions use to recognize the business. It is sometimes called a Federal Tax Identification Number, but EIN is the term you will see most often.
It is important to understand up front that the EIN is a federal number issued by the IRS. It has nothing to do with the Georgia Secretary of State or your Articles of Organization. Forming your Georgia LLC and getting an EIN are two separate steps with two different agencies. The state creates the entity; the IRS assigns the tax ID.

You must have an EIN if any of these apply
- Your LLC has more than one member — a multi-member LLC is taxed as a partnership by default and must have an EIN
- Your LLC has employees
- Your LLC has elected to be taxed as an S corporation or C corporation
- Your LLC owes certain federal excise taxes or has other specific IRS filing obligations
You can technically skip it (but probably shouldn't) if
Your LLC is a single-member LLC with no employees and no corporate tax election. In that narrow case, the IRS treats the LLC as a disregarded entity and you can use your own Social Security number for federal tax purposes. Timing tip: form the LLC first
Apply for the EIN after your Georgia LLC is officially formed, or at least after you have filed the Articles of Organization, so you use the exact legal name that is on the state record. Getting an EIN under a name that does not match your formed entity creates mismatches you will have to fix later with banks and the IRS.
Applying Without a Social Security Number
