What an EIN Is and Where It Comes From

An Employer Identification Number is a nine-digit number the IRS assigns to identify your business for federal tax purposes. It is sometimes called a Federal Tax Identification Number, and it functions like a Social Security number for your LLC — the identifier you put on tax filings, bank applications, and payroll paperwork.

Federal, not state

This is the first thing to get straight: the EIN comes from the IRS, a federal agency, not from the state of Maryland or SDAT. Forming your LLC with SDAT and getting an EIN from the IRS are two separate steps with two separate agencies. Apply by fax or mail

Getting the legal name wrong

Enter your LLC's legal name on the EIN application exactly as it appears in the SDAT record, including the designator like "LLC." A mismatch between your EIN and your formation record can cause friction with banks and the IRS later.

Applying for a second EIN unnecessarily

An LLC needs only one EIN for its life. If you already have one, do not apply again because you changed your address, added a member in some circumstances, or switched banks. There are narrow situations that require a new EIN — such as certain changes in entity structure — but routine changes do not.
