Change the Registered Agent for Your Montana Corporation

A registered agent isn't set once and forgotten. The moment the current arrangement stops meeting Montana's requirements, you need to update the record with the Secretary of State. Waiting doesn't make the problem go away — it just leaves the corporation exposed to missed legal service in the meantime.

• Your agent moved. If your registered agent relocated to a new address — even within Montana — the record has to reflect the current street address.

2. Log in with ePass Montana and open your corporation's record in the biz.sosmt.gov portal.
3. File the change of registered agent (Montana processes this as a statement of change). Enter the new agent's name and Montana street address, and confirm their consent as the portal requires.
4. Pay any applicable state fee at checkout and submit.
5. Keep the confirmation for your corporate records once the state processes the update.

• The new agent's full legal name and physical Montana street address
• Confirmation that the new agent has consented to the appointment

Because the filing is electronic, the update typically posts within Montana's normal processing window, and the new agent then appears in the public record.

Common mistakes that stall the change

• Naming an agent who hasn't consented. Montana requires the incoming agent to have agreed to serve. If you enter someone without their consent, the filing can be rejected or, worse, sit as an invalid appointment.
• Using a P.O. box. The registered agent address has to be a physical Montana street address. A P.O. box alone won't clear, because the point is in-person delivery of legal process.
• Assuming the annual report updates it for you. The April 15 annual report confirms your agent, but if the agent has already resigned or moved, you shouldn't wait for the report — file the change now. A gap between resignation and the next report is a gap where legal service can go astray.
• Forgetting to verify the filing posted. A change that quietly failed leaves you thinking you're covered when you aren't. Always confirm in the public record afterward.
