What an EIN Is and Why It Matters

An Employer Identification Number (EIN) is a nine-digit federal tax identification number issued by the IRS. Think of it as a Social Security number for your business. Your New York LLC uses its EIN on federal tax filings, when opening a business bank account, when hiring employees, and when dealing with vendors or lenders who need a tax ID on file.

The EIN is issued by the IRS, not by New York. It's a federal identifier, so it's the same regardless of which state you form in. New York then layers its own tax registrations on top, which we cover below — but the EIN itself is the foundational number you get first.

Why it's worth having even if not strictly required

Even a single-member LLC that could technically use the owner's SSN benefits from an EIN. It keeps your Social Security number off business paperwork, vendor forms, and bank applications — a meaningful privacy and fraud-prevention benefit. Most banks won't open a business account without one, so in practice nearly every LLC ends up needing an EIN anyway.

When Your New York LLC Needs an EIN

An EIN is required — not just recommended — in several situations:

  • Your LLC has more than one member. Multi-member LLCs are taxed as partnerships by default and must file a partnership return, which requires an EIN.
  • You plan to hire employees. Payroll, withholding, and employment tax filings all require an EIN.
  • You've elected S-Corp or C-Corp tax treatment with the IRS.
  • You need to open a business bank account. Nearly every bank requires the EIN.
  • You have a Keogh or solo 401(k) plan, or certain excise tax obligations.

The single-member exception

A single-member LLC with no employees, taxed as a disregarded entity, can technically use the owner's SSN for federal income tax. But given the banking requirement and the privacy benefit, most single-member owners get an EIN anyway. It's free and takes minutes.

When to Apply — Timing With Formation

Apply for your EIN after your New York LLC is officially formed — that is, after the Department of State has accepted your Articles of Organization. The IRS application asks for the legal name and formation details of the entity, so you want the LLC to exist first.

Why order matters

If you apply before the LLC is formed, or with a name that doesn't match your filed Articles, you can end up with an EIN tied to the wrong entity name — a headache to correct. Form first, confirm the exact legal name as filed, then apply for the EIN using that name. This keeps your federal and state records aligned, which matters when you open bank accounts and file taxes.

There's no need to wait on the New York publication requirement to get your EIN — publication and the EIN are independent. You can get the EIN as soon as the LLC is formed and handle publication on its own 120-day track.

How to Apply for an EIN

The IRS offers several application methods, and one is far faster than the rest.

Online (fastest)

Apply through the IRS EIN Assistant. The online application takes about ten minutes, and the IRS issues the EIN immediately at the end — you can download the confirmation and use the number the same day. The online tool is available during posted hours and requires a US Social Security number or ITIN for the responsible party.

By fax or mail

If you can't apply online — most commonly because the responsible party doesn't have an SSN or ITIN — you submit Form SS-4 by fax or mail. Fax turnaround is typically a few business days; mail can take several weeks. Non-US residents forming a New York LLC most often use this route.

What you'll need

  • The LLC's exact legal name as filed with New York
  • The LLC's address and formation date
  • The responsible party's name and SSN, ITIN, or (for foreign applicants) the SS-4 process
  • Your expected number of employees and the nature of your business

Watch for scams

The EIN is free directly from the IRS. Sites that charge a fee just to obtain an EIN are reselling a free government service. If you use a formation service that includes EIN retrieval as a convenience, that's a service fee for handling it on your behalf — not a government charge.

After the EIN — New York Tax Registrations

The federal EIN is the starting point, but New York has its own registrations depending on what your LLC does.

Sales tax

If your LLC sells taxable goods or services in New York, you must register for a Certificate of Authority to collect sales tax with the Department of Taxation and Finance before you make taxable sales. This is separate from your EIN.

Employer registrations

If you hire employees in New York, you'll register for state withholding and unemployment insurance with the appropriate New York agencies, using your EIN as the federal anchor.

The annual LLC filing fee and income tax

Your EIN also ties into New York's annual LLC filing fee (based on gross income) and your pass-through income reporting. The EIN identifies the entity across all of these — federal and state — so getting it right at the outset keeps everything downstream consistent.

How Mainstay Filing Can Help

When we form your New York LLC, we can also obtain your EIN as part of getting you operational — so you don't have to navigate the IRS application yourself, and so the EIN is tied to the exact legal name on your filed Articles. That alignment matters when you open a bank account and file taxes.

We handle the federal EIN retrieval; the New York state tax registrations (sales tax, employer accounts) depend on your specific activities, and we can point you in the right direction for those. The goal is to hand you a formed LLC with the federal tax ID in place so you can open a bank account and start operating without loose ends.

Frequently asked questions

Is an EIN the same as a New York state tax ID?

No. The EIN is a federal number from the IRS and is the same regardless of state. New York has its own separate registrations — like a sales tax Certificate of Authority and employer withholding accounts — that you set up with the Department of Taxation and Finance depending on what your LLC does. The EIN is the anchor that ties those state registrations together, but it isn't itself a New York number.

Do I need an EIN for a single-member New York LLC?

Not strictly for federal income tax — a single-member LLC with no employees can use the owner's SSN as a disregarded entity. But you'll almost certainly want one anyway: nearly every bank requires an EIN to open a business account, and using an EIN keeps your Social Security number off business paperwork. It's free and takes about ten minutes, so most single-member owners get one.

Should I get the EIN before or after forming the LLC?

After. Form the LLC first so the Department of State has accepted your Articles, then apply for the EIN using the exact legal name as filed. Applying before formation, or with a mismatched name, can tie the EIN to the wrong entity name and create a headache to fix. The publication requirement is separate — you don't need to wait on it to get your EIN.

How long does it take to get an EIN?

Online, it's immediate — the IRS issues the number at the end of a roughly ten-minute application, and you can use it the same day. If you apply by fax (common for applicants without an SSN or ITIN), expect a few business days; by mail, several weeks. Foreign owners without a US tax ID typically use the fax or mail route with Form SS-4.

Does it cost money to get an EIN?

No — the EIN is free directly from the IRS. Any site charging a fee just to obtain one is reselling a free government service. If a formation service includes EIN retrieval, you're paying a convenience fee for them to handle the application on your behalf, not a government charge for the number itself.
