Oklahoma Registered Agent Service Under the Business Hours Rule
Oklahoma's LLC procedures require the agent's office to be open during regular business hours to accept service of process, and they let the LLC itself serve as its own agent. Mainstay's Oklahoma service costs $149 a year. Below are the eligibility rules, the $25 change, what happens when an agent resigns and why the annual certificate notice goes to an email instead of the agent.
One price: $149/yr for your registered agent, with compliance reminders. Switching from another agent? The state's change fee is at cost.

What Title 18, section 2010 sets up
Oklahoma uses the terms registered agent and registered office, and the source is Title 18, section 2010 of the Oklahoma Limited Liability Company Act. The Secretary of State's Business Services office in Oklahoma City publishes the procedures on SOS Form 0074, and the Articles of Organization are SOS Form 0073, with a $100 filing fee.
The Articles ask for the registered agent's name and Oklahoma street address, the street address of the principal place of business, the email of the primary contact and the term of existence.
Section 2010 says the registered office may be, but need not be, the same as the principal place of business. Form 0074 says the registered agent accepts service of process in the event of a lawsuit against the company. Title 18 section 2010 covers LLCs, and corporations, LPs, LLPs and nonprofits can use Mainstay's agent service as well.
Who may serve under Form 0074
Form 0074 says the agent must be the domestic limited liability company itself, an individual resident of this state, or a domestic or qualified foreign corporation, limited liability company or limited partnership. The statute as amended also lists general partnerships, limited liability partnerships and limited liability limited partnerships.
The first item stands out, because Oklahoma allows the company itself to be its registered agent. It works only if the company has an Oklahoma street address that is open during regular business hours.
A commercial agent fits the last category. It is a corporation or LLC qualified in Oklahoma, and Oklahoma's rule is that its office be open during regular business hours.
The business hours standard
Section 2010 says each registered agent shall maintain a business office identical with the registered office which is open during regular business hours to accept service of process and otherwise perform the functions of a registered agent. The registered office address must be a street address, and P.O. boxes are not acceptable.
That is the law's rule for every Oklahoma registered agent, an individual or a company.
Four ways to cover the role
An Oklahoma resident with a street address in the state can serve as their own agent if they are reliably there during business hours. It costs nothing, and the address goes into the record.
The LLC can serve as its own agent when it has such an address and someone present during business hours. A business partner, an employee or an attorney who lives in the state can serve if they understand the job and will pass documents along.
A commercial agent maintains its own Oklahoma address and keeps it in the public record in place of yours. Moving your own home or office does not change the registered agent address.
Form 0075 and the 4% card charge
The change filing is the Change of Registered Agent and/or Office, SOS Form 0075, and the fee is $25. Paying by card adds Oklahoma's 4% card service charge, which makes $26 online. You can file through the Secretary of State's portal or mail the form in. A manager signs the statement for the LLC.
Under section 2010(B), the change is effective when the Secretary of State files the statement, unless a later effective date is stated, no later than the 90th day after filing. Oklahoma does not publish a processing time for the change, and mailed filings take longer once postal time is added.
We prepare and file Form 0075 when you move to Mainstay, with the state's fee passed through at cost. Oklahoma requires the new agent to have a street address with an office that is open during regular business hours.
If your agent resigns
An Oklahoma agent resigns by filing a copy of the resignation, signed and acknowledged by the agent, with a statement that the LLC was given notice at least 30 days before the filing. The state's form is SOS Form 0078, Resignation of Registered Agent, with a $25 filing fee. Under section 2010(D) the resignation is effective 30 days after it is filed, unless a later date is stated, no later than the 90th day after filing. So there are two 30-day periods to plan around.
If the LLC fails to obtain and designate a new registered agent before the resignation is effective, the Secretary of State is deemed to be the registered agent until a new one is designated. Section 2010(E) also lets service be made on the Secretary of State when an LLC has no registered agent or the agent cannot be found. The Secretary of State charges $25 per service, and section 2055 sets a $40 yearly fee, due July 1, for acting as an LLC's registered agent.
Do not let the Secretary of State become your agent by default. File the $25 Form 0075 with the replacement before the resignation takes effect.
The annual certificate, a separate email channel
An Oklahoma quirk is worth knowing. The annual certificate notice does not go to the agent. The Secretary of State sends it only to the email address given on the Articles, or the last known email of record. So keep that address current alongside the agent.
The certificate is due on the anniversary date of your LLC's registration each year. An LLC more than 60 days late on its certificate ceases to be in good standing.
Both failures are quiet. A stale agent address can let a lawsuit land with nobody there, and a stale email can let the certificate slip. Changing your agent does not reset or satisfy the certificate.
What the Articles hold and what they leave out
SOS Form 0073 asks for the name, the street address of the principal place of business wherever it is located, with no P.O. boxes, the email of the primary contact, the registered agent's name and Oklahoma street address, and the term of existence, which can be perpetual, a number of years or an end date. At least one person signs, and that person may or may not be a member.
There is no member list on the form. The principal place of business can be anywhere, while the registered office must be an Oklahoma street address, so an out-of-state owner fills the two lines with different addresses.
Price in Oklahoma, and the annual certificate
Oklahoma agent service from Mainstay runs $149 a year, renewing at the same $149, with compliance reminders. The annual certificate, due on your formation anniversary with a $25 state fee, which is $26 online by card, is yours to file under this service. For a new company, the $199 formation package files it, and it includes the agent along with the Articles of Organization and your EIN application.
Mainstay's Oklahoma address would be on the record. Same-business-day scanning and upload of service of process carries no fee. Each year the first three government mailings are scanned free, and every further piece has a per-piece scan or shipping fee. No tier includes free physical forwarding.
