An EIN is the federal tax ID your Pennsylvania LLC uses to open a bank account, hire, and file taxes. The IRS issues it for free in about ten minutes, and this page explains exactly when you need one, how to get it, what to do if you cannot apply online, and how the federal EIN fits alongside Pennsylvania's separate state tax registrations.

What an EIN Is and Why Your LLC Needs One

Issued by the IRS, an Employer Identification Number is a nine-digit federal tax ID assigned to your business. Think of it as a Social Security number for your business — a unique identifier the federal government, banks, and other institutions use to recognize the company. Despite the "Employer" in the name, you do not need employees to get one or to benefit from having one.

For a Pennsylvania LLC, the EIN is the number you will use to open a business bank account, file federal taxes, apply for licenses that require a federal ID, and set up payroll if you hire. It is a foundational piece of the company's identity, and getting it is one of the first things to do after the Certificate of Organization is recorded.

The EIN is free

This bears repeating because so many services blur it: the IRS charges nothing for an EIN. Any site advertising to "get your EIN" for a fee is charging you for a free federal form. You can complete the application yourself, at no cost, directly with the IRS.

When Your Pennsylvania LLC Must Have an EIN

Whether an EIN is strictly required depends on how your LLC is structured and what it does.

You must have an EIN if

  • Your LLC has more than one member. A multi-member LLC is taxed as a partnership by default and files a partnership return, which requires an EIN.
  • You have employees. Payroll tax reporting requires an EIN, full stop.
  • You have elected corporate tax treatment. An LLC taxed as an S corporation or C corporation needs an EIN.
  • You are subject to certain federal excise taxes or other filings that require one.

You should get one even if not strictly required

A single-member LLC with no employees can technically use the owner's Social Security number for federal income tax purposes. But almost every advisor recommends getting an EIN anyway, for two reasons. First, nearly every bank requires an EIN to open a business account, and a separate account is essential to maintaining your liability protection. Second, using an EIN keeps your Social Security number off business paperwork, vendor forms, and applications — a meaningful privacy and identity-theft consideration.

How to Apply for an EIN

The fastest and most common route is the IRS online application. It is genuinely quick when you have your information ready.

Applying online

Go to the EIN Assistant on IRS.gov and complete the application. It takes about ten minutes, and the EIN is issued immediately at the end — you can download the confirmation letter and use the number the same day. The online application is available during the IRS's posted hours and must be completed in a single session; it does not save partway through.

What you will need

  • The LLC's legal name exactly as it appears on the recorded Certificate of Organization
  • The LLC's address
  • The name and Social Security number or ITIN of the responsible party — the individual who ultimately controls the LLC
  • The reason for applying (started a new business) and the number of members

Timing matters

Wait until your Certificate of Organization is recorded before applying, so the LLC legally exists and the name you give the IRS matches the state's record. Applying before the LLC is formed can create a mismatch between the federal and state records that is annoying to untangle later.

If You Cannot Apply Online

The online application requires the responsible party to have a US Social Security number or ITIN. Applicants without one — commonly non-US-resident owners — cannot use the online tool, but they can still get an EIN.

Applying by fax or mail

Complete Form SS-4, the paper EIN application, and submit it to the IRS by fax or mail. Fax is considerably faster than mail — the IRS typically returns an EIN by fax within a few business days, whereas mail can take several weeks. International applicants can also apply by phone through the IRS's dedicated international line.

The responsible party

The IRS requires a responsible party on every EIN application — a real individual who controls or manages the LLC, not another entity. For a single-member LLC that is usually the owner; for a multi-member LLC it is one of the members. The responsible party's identifying information goes on the application, and the IRS uses it to keep the EIN tied to a real person.

The EIN Alongside Pennsylvania's State Tax Registrations

An EIN is a federal number, and getting it does not register your LLC for Pennsylvania taxes. These are separate systems, and confusing them is a common mistake.

What the state requires separately

After you have your EIN, register with the Pennsylvania Department of Revenue for whatever state tax accounts your business needs — a sales tax license if you sell taxable goods or services, an employer withholding account if you hire, and any others that apply to your activity. Many municipalities also require local tax registration, and Philadelphia has its own Business Income and Receipts Tax account. Your EIN is used to open those state and local accounts, but the accounts themselves are separate registrations you complete with the state and locality — not something the IRS handles.

Keeping the EIN safe

Treat your EIN as sensitive. It appears on tax filings and bank paperwork, and it identifies your business the way an SSN identifies a person. Keep the IRS confirmation letter (the CP 575) somewhere safe — banks and agencies sometimes ask for it, and it is the cleanest proof of your EIN. If you lose it, the IRS can provide a confirmation of the number, but it is easier to file the original away carefully.

Frequently asked questions

How much does an EIN cost?

Nothing. The IRS issues EINs for free through its online assistant, by fax or mail via Form SS-4, or by phone for international applicants. Any service charging a fee "to get your EIN" is charging for a free federal form. The EIN itself is never a cost of forming or running an LLC.

Does my single-member Pennsylvania LLC need an EIN?

Not strictly, for federal income tax purposes — a single-member LLC with no employees can use the owner's SSN. But you should get one anyway. Nearly every bank requires an EIN to open a business account, which you need to keep finances separate and protect your liability shield, and an EIN keeps your Social Security number off business paperwork.

How long does it take to get an EIN?

If you apply online with a US SSN or ITIN, the EIN is issued immediately at the end of the ten-minute application. If you apply by fax using Form SS-4, expect a few business days; by mail, several weeks. International applicants can also apply by phone. Online is by far the fastest route when you are eligible for it.

Can I get an EIN without a Social Security number?

Yes, but not through the online tool, which requires an SSN or ITIN for the responsible party. Applicants without one file Form SS-4 by fax or mail, or apply by phone through the IRS international line. Fax is much faster than mail. This is the common path for non-US-resident owners of a Pennsylvania LLC.

Should I get my EIN before or after forming the LLC?

After. Wait until the Certificate of Organization is recorded and the LLC legally exists, so the name you give the IRS matches the state's record. Applying before formation can create a mismatch between federal and state records that is a nuisance to fix later. Form first, then get the EIN.

Does getting an EIN register me for Pennsylvania taxes?

No. The EIN is a federal number and does not register you for state taxes. You separately register with the Pennsylvania Department of Revenue for accounts like sales tax or employer withholding, and with your municipality for any local taxes. The EIN is used to open those accounts, but the state and local registrations are their own steps.
